The FAA treats drone flights done for a business purpose as “civil” operations under Part 107, which means the remote pilot in command must hold an FAA Remote Pilot Certificate. Flying for a client, for pay, or to support a business (marketing, real estate, inspections, content creation) without that certification is not compliant with FAA rules.
Recreational flying is a separate exception under 49 U.S.C. §44809 and only applies when the flight is strictly for personal enjoyment.
